Senate Passes One Call Legislation; House Advances its Version

 

We wanted to let you know that the Senate passed Senate Bill 1235 today by a vote of 34 to 14.  This legislation will now go to the House for its consideration.

 

  • Senate Bill 1235 (Baker-R)  amending the Underground Utility Line Protection Law, extending the law’s sunset provision by 5-years, from December 31, 2016 to December 31, 2021, and to transfer oversight to the PUC.

 

  • Moreover, it places duties on facility owners to maintain records of notice to the One Call System, verify where underground utility lines run in certain instances, report violations, and participate in One Call’s member mapping system.
  • A Damage Prevention Committee, including representatives from utilities, municipalities, authorities, and excavators, would also be established to review findings and recommendations, issue warning letters, and make informal determinations.

 

  • Status:  Passed Senate 34-14, 9/27/2016
  • NOTE:  The Senate did not offer the technical amendments, which were recommended by the House Consumer Affairs Committee.  Specifically, page 34, line 3 should say nonmunicipally owned or affiliated owner industries… with respect to the damage prevention committee. Therefore, if and when the committee considers this legislation, the technical amendments will need to be considered.

 

With respect to Rep. Godshall’s House Bill 2308 (PA One Call extension), it was reported from the House Appropriations Committee and is positioned for final passage by the House as early as tomorrow.

 

  • House Bill 2308 (Godshall-R) amending the Underground Utility Line Protection Law, further providing for expiration.

 

  • Specifically, it extends the sunset date of the PA One Call Law by one year until December 31, 2017.

 

  • Status:  House Consumer Affairs, 9/1/2016 – Reported, 9/20/2016 – 1st Consideration, 9/20/2016 – Laid on Table, 9/20/2016 – Removed from Table, 9/21/2016 – Removed from Table, 9/21/2016 – 2nd Consideration, 9/26/2016 – Re-committed to House Appropriations, 9/26/2016 – Re-reported, 9/27/2016
